Red flag test
The test for actual or constructive knowledge of infringing activities on the part of an Internet service provider which has availed itself of the safe harbor provided by the Digital Millennium Copyright Act. The ISP is then obliged expeditiously to remove or disable access to the offending material, or suffer the consequence of being liable for the infringement.
